We don't know much except what we're reading.

Over on PFT, there's several articles, and Florio said he's been on radio shows discussing it all day. The woman has been hospitalized several times in the pysch ward for depression and post traumatic stress. Whether that is why she was admitted or not is something we'll have to wait and see on. But it also states she has lost 30 lbs since, which is a good deal of weight. If that is truly the reason for the admissions, that holds some meaning. Doesn't mean she'll have a case for it, though.

Not saying the claim is legit, but Ben isn't a goody two shoes. I know someone who went to Miami while he played and said...

We'll see. We may never really know. She may just get some money to just go away.

In addition to that, according to the most recent article posted, she isn't going after Harrah's where the "conspirators" all work. They are the deep pockets, more so even than Ben... so if you are only after the money, why leave out the biggest potential fish?

What bugs me is that ESPN is not reporting it.

It's very clear they're trying to sweep it under the rug much like Michael Vick was before PFT made such noise about it that it couldn't be ignored anymore.

agreed and their reasoning is such crap. they claim that they don't report such rumors as it's damaging of reputations, yet they are wildly inconsistent there too. i hate espn and i really wish schefter stayed at NFLN.

ESPN's media bias shines through all the time...it's sickening. If they didn't hold a virtual monopoly over the sports world I would not watch them.

I really wish CNN/SI didn't fold...

That's the thing.. it's not a rumor. A lawsuit WAS IN FACT filed... now debating whether he's guilty or not, that gets into rumors and speculation... but reporting the lawsuit is NOT a rumor.

I just want to bring up the fact and remind that this is a CIVIL suit.

He won't be "guilty" of anything. Jail is not a possibility unless the state takes up the case and brings charges.

Right now, he'd just owe damages for whatever tort she's alleging if he's liable.

Also, some people are talking about conspiracy. Again, as far as I know, that's reserved solely for criminal purposes. Not applicable here.

As I understand it from the article, she mentioned the alleged conspiracy in her civil complaint... so while nobody could go to jail for it being in her civil complaint. I suppose she intends to use it to help make her civil case that if nothing happened, then why was there this concerted effort to cover "nothing" up? Makes sense to me. She also named some of the alleged conspirators in her civil case... So the notion of a conspiracy to cover it up, seems very applicable here.

I think I got the impression from somebody else's post that there were conspiracy charges, so that wasn't directed at you.

As far as naming the other people responsible in her suit, my guess is that she's naming people to the lawsuit to straighten out the facts of who did what.

Another thing that strikes me, is the amount...$400,000....why so little, from a man that has a $100 million contract?
The cover up part to me sounds reasonable. I worked in casino's, and being able to have pro atheletes hang there helps business. If the boss really is so enamoured with Ben, it doesn't sound that far fetched to me.
Still, the money thing puzzles me. Maybe it has something to do with her hospital and doctor bills.

Can't find the link now, but she's suing ben for $440,000 in damages, an unknown number in punitive damages, and each of the other 8 for $50,000 in damages.

It was on yahoo news a little bit ago, and I'm not going to search for it now. I have a golf cart I need to work on.

The $400,000 is for damages she incurred - that doesn't include the punitive amount - according to the article I read.

Was talking about this to a Lawyer the other day (doctors office)...I don't know him or the ins and outs of the law...but what he said made sense.

He said the lower amount in a suit against Ben and the handful of Casino workers in a civil suit makes it more likely for a jury to award her the full thing...than if she just said 25 million. Jury could see Bens 100 Mill contract...and think...well he has the money...she has some problems..and (depending on what evidence there might be) something happened....lets give her the 400,000

Then if she wins this civil suit...she could use the Ben verdict against the Casino in a larger Civil Suit.....with the Ben case already being out there as evidence of wrong doing.

Maybe someone out there with some knowledge of the law and civil suits could chime in if any of that makes sense

I dunno - this is such a tough situation. If Ben had done this horrible crime, I hope that he wastes away in jail for many years.

But Andrea just doesn't seem that credible to me, given the current known facts. She could file a criminal lawsuit today, and the police would be forced to investigate. I find it hard to believe that after the civil suit was filed one year later, and all is in the open, that she would fear repercussions from Harrah's at this point about filing a criminal lawsuit.

I understand that possibly Andrea would have been traumatized by the assault, and wouldn't have been able to file charges for a period of time, but I don't buy that she is just filing a civil suit now, not criminal charges. Sounds like she is looking for mega-bucks.

I'm keeping an open mind about the situation - I'm sure there is a lot that's not being revealed yet.

That being said...when you look at Ben's past girlfriends...it does make one wonder. Natalie Gulbis, and Missy Peregrym

Rape is an act of violence, it has nothing to do with whether or not the rapist feels sexually attracted to their victims. Which is why once on a while you hear about elderly women getting raped. Get it now?

Absolutely. I never filed charges against the guy that date raped me (back in 1989, was my bf at the time). I just wanted to put it all behind me and forget about it. I was only 14 when it happened. Hell, my parents didn't even know about it until I was 26 and had already gone through years of therapy. (therapy not for this reason, but for bad marriage).

While the way this story has unfolded doesn't really pass the smell test that doesn't mean Ben gets a free pass.

Living just 30 miles or so from where he grew up I've heard enough stories in the past, whether true or untrue, to believe that there might be some smoke here.

I'll reserve judgement for now.
