theres the problem right there...i know even i am guilty of doing it sometimes!

from what i have seen and read it sounds like he was speeding, tried to run a either yellow turning red or a red light, and hit the guy. if he was under the influlence or not he is still guilty of not obeying the law! sun in his eyes or not its him not obeying the law! high or sober still not obeying the law! either way you look at it he took a mans life due to the fact he wasnt paying attention...he honked, and flashed his lights? whoopty freaking doo, try hitting the breaks, or steering out of the way...

its true when we first got him i thought he would turn it around and be a productive player for us...after last year i want no part of him on our team. why on earth did we keep him i will never know, but if he goes to jail we get back our roster bonus and can then use that money somewhere else. my question is though does his salary still count against us if he is found guilty and sent to jail/prison?

Miami Beach police are awaiting the toxicology report for Cleveland Browns wide receiver Donte Stallworth before releasing information about his car accident that killed a pedestrian.
Police spokesman Juan Sanchez said Monday the routine blood work hadn't made it to the laboratory yet and added that results are expected to be released by the end of the week.

Authorities said Stallworth was headed toward the beach when he hit Mario Reyes, 59, with his Bentley on Saturday morning on a busy causeway linking Miami and Miami Beach.

Stallworth made his first public comments Wednesday, issuing a statement through the Browns:

“My family and I are grief stricken over the tragic accident which occurred Saturday on Miami Beach where Mario Reyes sadly lost his life. My thoughts and prayers are with the Reyes family during this incredibly difficult time. Unfortunately, since this accident is still under police investigation, I cannot comment further on the matter at this time.”

No charges have been filed against Stallworth, who was cooperating with police. A message seeking comment was left on the voicemail of his agent, Drew Rosenhaus.

The Browns said in a brief statement Saturday that they were aware of what happened but wouldn't comment until the investigation is complete.

A videotape obtained by The Miami Herald shows Stallworth being given a sobriety test just feet from paramedics trying to revive Reyes.

Stallworth signed a seven-year, $35 million contract with the Browns as a free agent before last season, but he hardly played because he was hurt. He was scheduled to receive a $4.75 million signing bonus Friday.

Reyes had worked all night at his job with shipping company Bernuth Agencies, which is located just feet from the crash. His family and co-workers said he had clocked out only minutes before the accident around 7 a.m.

Sunday, Reyes was described by relatives as a "family man."

"He spent all his free time with his family," Reyes' brother-in-law, Francisco Fajardo, told The Associated Press on Sunday. "He was on his way home."

Miami Beach police would not confirm the television station's report that he had a blood alcohol level of .12. The legal limit is .08.

''We have not released anything regarding the blood work,'' said Jenny Velazquez, a Miami Beach police spokeswoman. ``We're not confirming anything.''

No charges have been filed against Stallworth, 28, who is seen on a video obtained by The Miami Herald being given a sobriety test by two Miami Beach police officers.

Stallworth, who is cooperating with police, issued a statement Wednesday expressing his condolences to the family of Mario Reyes.

''My family and I are grief stricken over the tragic accident which occurred Saturday on Miami Beach where Mario Reyes sadly lost his life,'' Stallworth said in a prepared statement. ``My thoughts and prayers are with the Reyes family during this incredibly difficult time.

Reyes, 59, was getting off work as an overnight crane operator and trying to cross the street to catch a bus home just after 7 a.m. He died at the scene.

Reyes was born in Cuba and left as a teenager for a better life in the United States. He worked numerous construction jobs. He was an avid baseball fan, particularly fond of the Florida Marlins. Reyes is survived by his wife of almost 20 years, Catalina, and the couple's 15-year-old daughter, Daniela.

This is purely why you simply cannot take the risk to drink and drive.

You could possibly not be "at fault" and still be involved in a tragedy--but you will still get the blame.

I'll wait for an official notice, but if it's true that he was drunk, then Stallworth deserves every amount of punishment he gets.

If he wasn't and this story is false, this reporter deserves every amount of punishment he/she gets.

I'll wait until the entire story comes out before I form an opinion. It's always possible the guy had breakfast and a few Tecate's before trying to cross the street.

However, Stallworth was driving drunk. There's no denying that. He killed a guy. Regardless of who's at fault, there's no denying that either.

If it's at all possible, it's time to go after his bonus while trying to void his contract.

That's usually when they get people. People to drink heavy the night before.Go home and go to bed then get up early to go to work (or the beach) and they get in an accident. Most feel ok and thought sleeping for a few hours and they are good but they still might be over the limit.

If you tied on a good one the night before and went to bed even as early as midnight, it would still be pretty easy to have a .12 bac with your hangover at 7:00am. If you stayed out until the bars (or after-hours club) closed, then it gets even easier.

This language tells it all.... If they hadn;t completed the bloodwork, they would have used the same messaging they have all along about the length of time it takes to process.

This change in language is CYA move. They likely haven;t fulfilled obligations in informing Stallworth or the lawyers or whoever tehy are bound to provide first notice to and, as such, they're using covering language to neither confirm or deny.

Stallworth is in a BAD spot... I really doubt this is something he can get away with as a small jail stint or probation or what have you. The guy died....makes this vehicular manslaughter which they really can;t let go with a slap on the wrist.


With Stallworth almost certain to be cut as a result of all this, suddenly Braylon out the door looks alot less certain.

I guess it just depends how hammered you were.

You process about a drink a hour, so even if he hit the hay at 2 he would have had time to drop about 5 drinks worth from the system..if he was still at .12 at 7am, he must have been in a drunken stupor when he finally passed out......unless he nailed down a few 'hair of the dog" shots before he left.

We will see how it plays out.....I still don't see why he was released if he was .12...that is pretty darn drunk...you slur pretty good at that point.

Something just isn't adding up here.

Well, for starters, Voluntary Manslaughter is different than involuntary. Then there's Goodell's stance.

He won't get off easy, but he'll get off easier than the average Joe because of how much money he can throw at the problem.

Look... you don't make a name for yourself (or sell papers or get internet hits) by reporting on stuff AFTER the official announcement...

I suspect that the reporter has a source inside the police department or lab who they deem to be credible (probably because they have been right before) and the editor evidently agrees that the source is credible.. and perhaps they even have a second source (ideally) that corroborates that story...

and I'm no big fan of the media...

Clubs and bars in South Florida CAN stay open till 4:00 AM. Not all of them do, but they are allowed. They have to stay shut from 2 - 4 hours then they can re-open.

Maybe it is responsible if it's true. I mean as Peen says, how did Stallworth have .12 and the police didn't arrest him on the spot??? It could be because the reporter is full of BS and DS wasn't drunk at all........or it could be DS is a football player with big time lawyers that avoided it. IF it's the latter, and it were my father that was killed I would be happy the media wasn't letting them sweep it under the rug.

Assume the bars close at 2 am in Miami (they don't, they close at 5), it's very possible to wake up still drunk and confuse it with being hungover...when I heard 7:17 am I knew it wasn't good. Something told me an athlete in the offseason was not driving around to get a cup of coffee

does anyone have a list of the WR's that are left in FA? sounds like we are going to need one.....and i hate to say i told you so because someone lost their life...but!

There's a searchable database on ESPN.com. Looks like a few interesting WRs still out there.

Looking at the list, first name that I noticed that I had any interest in was Mark Clayton (RFA Ravens) depending on how much they tendered that would be a nice pick up for a #2 WR. (Although I'm sure Diam will call him a BUM anyways) I liked this kid coming out and he's not exploded or imploded, but he's made some decent grabs from the little playing time I've seen of him.

Also, Reggie Williams is listed as a UFA from the Jags. He is serviceable. Not a huge talent, but he's not a bad grab if he comes at the right price.

wow there is still some good talent left to be had, alot are older but i wouldnt mind trying to get Lelie, Holt, K.Robinson, or even M.Harrison could really help out our sad WR core

A friend of mine got an underage DUI at noon from drinking the night before. I don't remember what he blew, but it was less than .08 and more than .02.

Underage DUI's are a real scam... You're either over or you're not. Age has nothing to do with it. Charge them with underage drinking and whatever their traffic offense is, not DUI.

Stallworth... I can't judge you.. So i'm not going to bad talk... But man... I would hate to reach the pearly gates and have to answer to that call of killing someone b/c I was driving drunk.

More reason not to drink while underage and especially not to drive while drinking as well at that age. Also consider that you have an inexperienced driver behind the wheel that was drinking alcohol which impairs judgement.. Not a good mix.

Maybe I missed it but in re-reading the previous stories nowhere does it say he took a breathalyzer test at the scene. If they didn't think he acted drunk maybe they didn't give him any field sobriety tests and figured the blood test was good enough.

And I don't think they let him drive home. I'd imagine they impounded the car if only for a little while.

I also would imagine they had at least one additional confirmation of the story before they went with it. If this is true I'd say the NFL has seen the last of Dante Stallworth for, well, forever.

Maybe I'm the only one but I don't have a problem with it... if kids are drinking AT ALL under age and driving then hit them hard, maybe they'll learn.

Something about an officer saying... You're 17 and you've been drinking and driving, you blew a .06... here's your $100 ticket for going 55 in a 30, have a nice evening..... doesn't exactly sound right either.
